The Clerk to the Board explained the fire evacuation procedure and the arrangements and constraints relating to the filming or recording of the meeting.

The Board considered an application for the demolition of an existing garage and the erection of a part two part single storey side rear front extension including front canopy.

 

The Chairman introduced Mr Hall who spoke opposing the application and Mrs Khunkhan who supported it.

 

The Chairman assured the Applicant that the Application would be determined solely on legitimate planning considerations and that no weight would be accorded to irrelevant issues which had been posted by objectors on the Council’s Planning Application portal.

 

Members discussed the Application and the site visit which had taken place 

 

RESOLVED

 

That the Application be refused for the following reasons

 

“The proposed extensions by virtue of their resultant bulk will result in an unacceptable overbearing impact on adjacent properties which already have reduced light to the rear due to the north-facing aspect and rising land levels of the rear gardens. The proposal is considered to be over-development of this modest semi-detached house, appearing incongruous and dominant on the street scene which will be detrimental to the character of the area. The proposal is therefore considered to be contrary to Policy B1 of the adopted Local Plan 1995 and Policies DP5 and DP7 of the emerging Development Policies Plan.”

 .

That the application be approved subject to the Conditions, Reasons and Informatives contained in the Report, as amended at condition 11 as follows

 

“During enabling, demolition and construction phase, the hours of working, including deliveries and collections to and from the site, shall be restricted to:

 

Monday to Friday 08:00 – 18:00

Saturday 08:00 – 13:00

No work on Sundays or Public Holidays

 

Reason: In the interests of protecting the amenity of nearby residential properties.”

That the Application is approved subject to

 

1.    the Conditions, Reasons and Informatives set out in the Report, together with,

 

2.    the amendment of Condition 4 to read

 

“Prior to occupation of the development hereby approved the first floor windows in the north-west and south-east elevations of the house and the first floor windows of the detached outhouse shall be fixed shut and obscure glazed with a minimum obscurity level of 3 as referred to in the Pilkington Texture Glass Range leaflet or nearest equivalent as may be agreed in writing by the Local Planning Authority. The obscured glazing shall be maintained thereafter”

 

3.    The additional of the following Condition 9.

 

“The detached building, hereby approved, to be used for ancillary residential accommodation shall not be fitted with a kitchen and shall remain as a building without any kitchen facilities in perpetuity.”

 

“Reason: To ensure that the property cannot be occupied as a separate residential dwelling.”

Councillor Armitt thanked Officers for the composition of the Conditions proposed for this application which had addressed the concerns raised by local residents over the proposals.
