Minutes:

The Minutes of the meeting of the Licensing Committee held on 8 June 2016 were confirmed as a correct record of that meeting.

Urgent Items

The Chairman will announce his decision as to whether there are any urgent items and their position on the agenda.

Whilst there were no urgent items for the Committee to consider, the Licensing Officer gave details of a number of occasions where enforcement actions had been carried out by Officers in conjunction with other agencies.

The Committee was reminded that at its meeting held on 8 June 2016 it had approved, for consultation purposes with interested parties, a revised draft policy for the licensing of Sexual Entertainment Venues together with revised Terms of Reference for the Licensing Sub-committee, to enable it to deal with applications for Venue Licences.

 

It was reported that the consultation exercise had been undertaken in accordance with national guidelines and legislation and that no response had been received.

 

RESOLVED

 

      I.        To note that no responses had been received to the consultation on the draft Statement of Sexual Entertainment Venue Policy.

 

    II.        That the Statement of Sexual Entertainment Venue Policy for the period 1 October 2016 to 30 September 2021, as set out at Appendix A to the report, be adopted.

The Committee received a report which informed Members that the current Hackney Carriage & Private Hire Licensing Policy, first adopted on 15 July 2010 [Min No 24]’ would expire on 31 March 2017 and that it would be necessary to consult with interested parties on a new statement of Policy to commence on 1 April 2017.

Members noted that the Policy detailed the criteria that applicants had to meet to become a licensed driver, operator or to licence a vehicle.  

The Committee was informed that a full review of the current Policy had resulted in a number of proposed amendments, and that these were summarised as an Appendix to the report.  

Additionally it was noted that the proposed recommendations resulted from consultation with trade representatives, legislative changes including the introduction of the Deregulation Act 2015 and clarification to areas of the policy in relation to Safeguarding, Prevent (Counter Terrorism) and Vehicle Criteria.

Concern was expressed that under the current Policy an applicant could be licensed with only one year’s driving experience and that this was an insufficient period of time.

 

RESOLVED that:

 

 I.             The revised draft Hackney Carriage and Private Hire Policy Statement, attached as an Appendix to the report, be approved for the purposes of consultation, subject to the amendment of the period of driving experience necessary to three years for an applicant to be licenced;

 

II.             Consultation is undertaken in accordance with national guidance; and,

 

III.             If comments and representations are received, a further report be submitted in order to consider any necessary changes to the draft Policy, prior to its adoption by the Committee.
