Minutes:

        The Appeals Panel considered an appeal against a decision to terminate a contract of employment by reason of capability due to ill health.

 

        The Appeals Panel considered the Appellant’s submission and the case for Dartford Borough Council’s management.  Members noted that the grounds of appeal referred to the Council dismissing with undue and unprecedented haste, given the short time of absence through sickness and that part-time working had not been considered.

 

After considering the evidence presented at the hearing,the Appeals Panel were satisfied that the decision to terminate the Appellant’s contract of employment on the grounds of capability due to ill health, was fair and was carried out in a fair and appropriate way.

 

The Appeals Panel RESOLVED unanimously to dismiss the Appellant’s appeal and uphold Management’s decision to terminate the Appellant’s contract of employment by reason of capability due to ill health.
