The Board considered a report on an application to allow the demolition of an existing dwelling and structures and the erection of a three storey building containing five apartments (2 two bedroomed and 3 one bedroomed) the erection of 4, three bedroomed dwellings, the widening of existing vehicular access and the construction of an access road, parking, amenity space (private and communal) and landscaping.

 

Members expressed concern that the application represented an over development of the site and that there were possible air pollution and noise issues related to the site.

That a decision on this application be deferred pending a Member visit to the site.

Approval (Note: Application only seeks an extension of time for issues set out in resolution as previously agreed by Members. There has been no change in the application).

The Board received an application for an extension of time to allow for the completion of a S.106 agreement in contained in consent 17/01814/FUL.  The development comprises a mixed use development including 151 residential units (16 x one bed apartments, 115 x 2 bed apartments, 6 x 3 bed houses and 14 x 4 bed houses), 832.19 square metres floor space (Use Class A3/A4); 187.5 square metres training centre (Use Class D1); riverside walk; boat trailer park development platform and slipway; permanent diversion of Public Right of Way DS1; sustainable urban drainage systems; and associated works.

 

RESOLVED

That:

 

1.    The application for an extension of time be approved subject to:

 

a)    The conditions set out in the attached report to the Board

 

b)    the completion of a s106 agreement in accordance with the heads of terms set out in the report to DC Board dated 14th December 2017 by 28th February 2020

 

c)    completion of the proposed Deed of Variation in relation to the s106 associated with planning permission 08/01601/FUL by 28th February 2020

 

2.    Delegated authority be granted to the Development Manager to deal with the application for and subsequently confirm orders for the diversion of the Public Right of Way DS1; and

 

3.    Legal action be pursued with regard to breaches of the existing s106 agreement from planning application 08/01601/FUL if significant progress on outstanding issues is not made by 28th February 2020.

As this was the last meeting of the Board in 2019, Councillor Hunnisett thanked all Board Members and Officers for their hard work in the past year and wished all a Happy Christmas and peaceful and prosperous New Year.
