In view of the large number of members of the public present for this item the Chairman decided, with the agreement of the Board, to take this item as the first planning application on the agenda.

 

Councillor J Jones joined the meeting during consideration of this item and took no part in the discussion or voting. He confirmed to the Chairman upon his arrival that he had no interests to declare in respect of any items on the agenda.

 

The Board considered a retrospective planning application for the part change of use of residential property at Openake, New Barn Road, Longfield DA3 7LG to allow private swimming tuition within specified times.

 

Members’ attention was drawn to the circulated update.

 

The Chairman introduced Mr Darren Salter who spoke against the application and the applicant, Mrs Denise Calver, who spoke in favour of the application. Mrs Calver however, made the point that the condition as proposed, requiring 30 minutes between lessons, would not work with regard to the way her business was run, as many parents arrived with siblings in different classes (eg. beginner and intermediate) and therefore would have to wait 30 minutes for the next class.

 

The Board considered the application, the update, the statements made the speakers and information provided in response to questions asked by Members and determined that the use of this residential property for private swimming tuition would result in increased activity and disturbance which would lead to unacceptable harm to the residential amenity of neighbouring occupiers and their enjoyment of their properties. It was not considered that conditions could satisfactorily mitigate these impacts. The use was therefore felt to be contrary to Policies DP5 and DP7 of the adopted Dartford Development Policies Plan 2017.

 

The property provided inadequate car parking and on-site turning to meet the needs arising from the swimming tuition classes. The vehicular activity generated by the use had the potential for detriment to highway safety due to increasing the likelihood of vehicles reversing onto a busy classified road and would result in pressure for parking on surrounding roads. It was therefore considered to be contrary to Policies DP3 and DP4 of the adopted Dartford Development Policies Plan 2017 and the adopted Parking Standards SPD.

 

The use of this property for private swimming tuition would result in an intensification of activity at this residential property and change to its character, by reason of extensive parking, the need for a bound-surfaced and demarcated parking area, and consequent loss of soft landscaping and opportunities for further soft landscaping which has a harmful impact on the character of the front garden. The property falls within the New Barn Area of Special Character and it was considered that changes to the property to accommodate the business use would contribute to the erosion of the character of the area contrary to Policies DP2, DP7 and DP12 of the adopted Dartford Development Policies Plan 2017.

The Board considered a report which sought authority to confirm Tree Preservation Order No:1 2018 – 1 No. Walnut Tree, The Sun Public House, 16 Swanscombe Street, Swanscombe, Kent DA10 0BG without modification.

 

The report provided details of an objection received during the consultation on the Tree Preservation Order and the advice from the Council’s tree Consultant.

 

            RESOLVED:

 

That for the reasons detailed in the report, Tree Preservation Order No:1 2018, The Sun, 16 Swanscombe Street, Swanscombe, Kent DA10 0BG be confirmed without modifications.

The Board considered a report which provided information on the first stage of consultation for a New Local Plan. This had also been considered and approved by the Cabinet on 24 May 2018 and followed a review of the 2011 Dartford Core Strategy’s performance which had identified the positive progress in applying most aspects of the Core Strategy, and confirmed its continuing relevance as the strategic Local Plan for the Borough. The 2011 Core Strategy Local Plan continued to guide the overall distribution and balance of development in the Borough and ensured that a sufficient supply of deliverable housing land was in place for the future.

 

            RESOLVED:

 

1.      That the first stage consultation being held for a six week period on a ‘Strategic Issues’ discussion paper be noted, which will inform further public consultation on proposals for a new Local Plan;

2.   That it be noted that a statutory Core Strategy Review: Policy Monitoring report has been produced as summarised in the Appendix to the report; and

3.   That the other supporting information presented to Cabinet on 24 May 2018, including the programme to produce a new Local Plan (‘Local Development Scheme’), and the 2018 Five Year Housing Land Supply report, be noted.

Minutes:

Members received the Development Control section Quarterly Monitoring Report for January 2018 to March 2018. It was noted that a temporary planning officer had been recruited to assist with the backlog of decisions to be dealt with that had arisen towards the end of 2017 due to staff shortages. The Board noted the forthcoming planning inquiry and commended the Development Control section for dealing with an increase of demand and for its success in having 4 of the 5 appeal decisions dismissed during the quarter.
