Councillor D E Hunnisett declared a personal interest in agenda item 6 (11/01413/FUL) – Former Dartford Police Station Site, Instone Road, on behalf of all Conservative Members present as an objector was known to the Conservative Group.

 

Councillors I D Armitt, P Kelly, J I Muckle and G T Prout declared a personal interest in agenda item 6 (11/01413/FUL) – Former Dartford Police Station Site, Instone Road, as contributors on the application were known to them.

 

Councillor I D Armitt declared a personal interest in agenda item 11 (12/00275/FUL) Northaw, Main Road, as contributors on the application were known to them.

 

The Legal Services representative declared a personal interest in Parish/Town Council membership on behalf of all Parish/Town Councillors present at the meeting.

Proposal: Erection of 1502m2 retail store (Class A1) with 79 associated car parking spaces

 

RECOMMENDATION: Refusal

Minutes:

The Board considered a report in connection with the above application for the erection of 1502m² retail store (Class A1) with 79 associated car parking spaces.

 

Members attention was drawn to the update circulated and advised that the applicant had submitted revised drawings and also additional letters of support had been received.

 

Following the concerns raised, the Chairman explained the numerous reasons why the applicants had not been successful in registering to speak at the meeting.

 

The Board discussed the reasons for refusal, and although Members welcomed the principle of the retail store (Lidl) in the Town Centre, in the adopted Core Strategy the application site was not identified for retail use.  The Board expressed its disappointment with the consultation methods used by the applicant and that they continued to pursue the site even when officers had advised them of the position in January 2011.

 

                        RESOLVED:

 

That planning permission be refused for the reasons set out in the report.

Proposal: Application for renewal of Planning Permission DA/06/01058/OUT for outline application for erection of 175 residential units, public open space, access roads and associated parking

 

RECOMMENDATION: Approval, subject to the completion of a s106 agreement within six months of the date of this resolution

The Board considered a report in connection with the above outline application for the renewal of Planning Permission DA/06/01058/OUT for outline application for erection of 175 residential units, public open space, and access roads and associated parking.

 

Members’ attention was drawn to the update circulated.

 

Members of the Board expressed their disappointment that the affordable housing contributions for the application were now only 15%. 

 

Officers explained that the applicants had submitted a viability assessment which showed that if the affordance housing level was set at 15% then there would still be significant sums available for other contributions, such as education and transport.   If the affordable housing provision was increased, then the sums available for the other contributions would decrease.

 

The Board felt that the affordable housing provision should be higher and it was moved and duly seconded that the affordable housing provision be changed to 20%.

 

Upon being put to the vote it was carried.

 

                        RESOLVED:

 

That the application be approved subject to: -

 

(i)        the conditions, reasons and informatives set out in the report.

 

(ii)     the completion of a s106 agreement, with the affordable housing level be increased to 20% and the other contributions reduced pro rata, within six months of the date of this resolution.

 

(iii)    condition 01 being amended to read as follows:

 

          01          Approval of details of the siting, design and external appearance of the building(s) and the landscaping of the site (hereinafter called "the reserved matters") shall be obtained from the Local Planning Authority in writing before any development is commenced.  Application for approval of the reserved matter(s) shall be made to the Local Planning Authority before the expiration of eighteen months from the date of this permission.  The development hereby permitted shall be begun either before the expiration of two years from the date of this permission, or before the expiration of one year from the date of the last of the reserved matters to be approved, whichever is the later.

That the application be approved subject to: -

 

(i)         the conditions, reasons and informatives set out in the report.

 

(ii)        the inclusion of the following additional condition:

 

19          Before commencement of any building operations on site, details of a watching brief in accordance with a written programme and specification, shall be submitted to and approved by the Local Planning Authority.  This should be implemented by an archaeologist approved by the Local Planning Authority so that the excavation is observed and items of interest and finds are recorded.

 

Reason: To ensure that features of archaeological interest are properly examined and recorded in accordance with Policy B12 of the adopted Dartford Local Plan.

 

(iii)       the inclusion of the following additional condition:

 

04        Construction work by its nature can easily destroy or remove buried archaeological remains.  While a formal programme of archaeological investigation is not required as a condition of this permission it is important that an archaeologist, who knows what to look for, is allowed access to the site during construction works to inspect below ground trenches for archaeological evidence, whether structures or finds.  This should normally be possible within the construction process and should not hold up construction works.

14        Prior to occupation of the development hereby approved, a 3 metre high acoustic barrier fence shall be permanently erected along the south and west boundaries of the site as identified on the submitted location plan, in accordance with details to be submitted to and approved by the Local Planning Authority beforehand.

 

(iv)       the inclusion of the following additional informative:

 

The applicant is advised that details pursuant to Condition 6 should also include attenuation measures to ensure that noise generated by the proposed external plant at the first floor plant deck is 5dB below lowest night time background level.
